1. Who is responsible for your Personal Data

For the purpose of the relevant data protection legislation, we are the data controller. This means that we are responsible for deciding how we hold and use Personal Data about you.

We have appointed a data protection officer (DPO) who is responsible for overseeing questions in relation to this privacy policy. If you have any questions about this privacy policy, including any requests to exercise your legal rights, please contact the DPO using the details set out below.

You have the right to make a complaint to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.


2. The Personal Data we collect about you

Our main reason for collecting your Personal Data is to provide and improve the service, products and experiences that you and our customers expect from us.

Personal Data means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data) so that it can no longer be associated with you.

We collect Personal Data about you in a number of different ways including:

  1. Information you share with us through our website, by email or phone, in person at our events, exhibitions, stands, or otherwise;
  2. Information about how you have engaged with email communications that we have sent you;
  3. Information from your online interactions through cookies and similar tracking technologies (see the Cookie Notice for further information);
  4. Publicly available data, such as information from your social media interactions with us or posts about us;
  5. Information from third party data providers to whom you have given your permission to share your data with us.

The Personal Data that we process about you will mainly fall into one of the following categories:

Your preferences in receiving marketing from us and our third parties and your communication preferences. Information about your marketing choices, your interests, preferences, feedback and survey responses.

If you share the details of other people with us (for example, if you have bought a product or service for another person), then you will need to check with that person that they are happy for you to share their Personal Data with us, and for us to use it in accordance with this privacy notice.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data) 

Our website, products and services are not directed at children. We do not knowingly collect Personal Data relating to children without parental and/or legal guardian consent. If we discover that we have collected Personal Data from a child without parental and/or legal guardian consent, we will delete the information as soon as possible.

3. How and why we use your Personal Data

We will only use your Personal Data when the law allows us to, we are not allowed to process Personal Data if we do not have a valid legal ground. Under the General Data Protection Regulation (GDPR), the “lawful bases” we rely on for processing this information are:

  1. Contract – e.g. we have to process your product ownership details to provide you with the aftersales warranty support.
  2. Consent – e.g. we will send you marketing communications where you have provided consent.
  3. Legitimate interests – e.g. we will process order information to detect fraudulent activities and protect our interests and those of our customers.

 

We have set out below a description of all the ways we plan to use your Personal Data:

  1. To provide products and services, including:
  • To connect you with a nearby distributor or dealer if you are interested in signing up for a demo ride or making a purchase;
  • To manage and coordinate the purchase and delivery, where applicable;
  • To respond to your queries, through various channels such as online, over the phone, post, web chat;
  • To send promotional or communication materials, and to keep you updated on our latest product announcements, owner offers, opportunities to test new products, or upcoming events;
  • To contact you when products are next in stock.

 

  1. To provide support, including:
  • To answer any requests or comments you may have about our products, services, and website;
  • To provide after sales support of your products;
  • To provide you information about your warranty;
  • To send you important owner updates about products that you have purchased. These updates are for your benefit only and are not marketing related.

 

  1. To use data analytics to improve our website, products/services, marketing, customer relationships and experiences, including:
  • To ask you to leave customer feedback

 

  1. To protect our company and our customers
  • To detect and prevent criminal activity, including fraud;
  • To keep our websites, products and IT systems secure;
  • To assist in any disputes, claims or investigations relating to your product or warranty matters;
  • To comply with our legal obligations; and
  • To provide updates to you about significant changes to our policies, terms and conditions and any other matters which we may need to inform you about.

 

We want to make sure you’re happy with the communications you receive from us. We do this by either offering you the opportunity to opt out (e.g. unsubscribe from mailing list) or requiring you to opt in (e.g. consent to marketing emails). 

Ultimately, the reason we handle your Personal Data in the way that we do is so that we can directly or indirectly, improve our products, services and your overall experience. Whatever our justification for handling your Personal Data, we make sure that we take steps to honour our commitment to protect your privacy.

4. How long do we keep your data?

We only keep your Personal Data for as long as we need to, to be able to use it for the reasons given in this privacy notice, and for as long as we are required to keep it by law.

The actual period for which we store your Personal Data will vary depending on the type of Personal Data and the purposes for which we process your Personal Data. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

For example, when you register a product with us, we will store information about you and your purchase for at least the term of the warranty period. We may also contact prior owners should the need arise, for example, while the current owner is supposed to contact us to transfer ownership via our website, we regularly are contacted by the new owner. Similarly, in the event we discover a motorcycle has been stolen, we also have the ability to contact the registered owner.


5. Sharing and transferring your Personal Data

We never sell your Personal Data to anyone and only share it as outlined in this privacy notice or when you ask us to. We do not transfer your Personal Data outside the European Economic Area (EEA).

We may share your Personal Data with certain third party service providers, in such cases, they will only have access to the Personal Data they need to perform those services. For example, when you express an interest in our products, we might share your contact details with your nearest dealer to arrange a product demonstration. Our third parties will keep your Personal Data confidential, must not use it other than instructed by us and must always act in accordance with this privacy notice.

The third parties fall into the following categories:

  • Distributors and dealers, who help us to sell our products and provide services to you;
  • Those helping us to deliver products to you;
  • Those helping us to provide you with relevant and interesting communications (e.g. marketing and advertising agencies);
  • Governmental third parties including the DVLA, the Office for Low Emission Vehicles, HMRC, law enforcement bodies.

We will also share your Personal Data if we are required to do so by law, including in response to a legal process, such as a court order, or to comply with other national or local laws.

Finally, in the process of purchasing our products you may interact with a third party who will be independently responsible for the Personal Data that you provide. For example, if you purchase our product under finance, your finance agreement will be directly with that third party and you should read their privacy notice(s) separately.

We provide links to other websites which are not operated and controlled by us. We have no control over and are not responsible for the content of those sites or how the third parties responsible for them collect and use your Personal Data. We do not endorse or make any representations about third party websites.

Third party websites usually have their own privacy notices explaining how they use and share your Personal Data. You should carefully review those privacy notices before you use these websites to make sure that you are happy with how your Personal Data is being collected and shared.

 

6. How we store your Personal Data 

We will only retain your Personal Data for as long as necessary to fulfil the purpose for which it was collected or to comply with any legal, regulatory, tax, accounting or reporting requirements.

We have implemented adequate security measures to protect your Personal Data against unauthorized, accidental or unlawful destruction, loss, alteration, misuse, disclosure or access and against all other unlawful forms of processing.

We limit access to your Personal Data to those employees, contractors and other third parties who have a genuine business need to know. They will only process your Personal Data on our instructions for the purposes set out and they are subject to a duty of confidentiality.

 

 

7. Your data protection rights

Under data protection law, you have rights including:

  • Your right of access – You have the right to ask us for copies of your Personal Data.
  • Your right to rectification – You have the right to ask us to rectify Personal Data you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 
  • Your right to erasure – You have the right to ask us to erase your Personal Data in certain circumstances. 
  • Your right to restriction of processing – You have the right to ask us to restrict the processing of your Personal Data in certain circumstances. 
  • Your right to object to processing – You have the right to object to the processing of your Personal Data in certain circumstances.
  • Your right to data portability – You have the right to ask that we transfer the Personal Data you gave us to another organisation, or to you, in certain circumstances.

If you, or a party authorised to act on your behalf, would like to exercise any of your rights in relation to your Personal Data, please email DPO@motoelectric.co.uk

We will also need to confirm your identity before acting on certain requests. We may not be able to respond to your request or provide you with Personal Data if we cannot verify your identity, or authority to make the request on someone else’s behalf.

You are not required to pay any charge for exercising your rights. If you make a request, we aim to respond to you within one month.


8. Changes to this privacy notice

We will regularly review and update this privacy notice; we encourage you to review it periodically. This privacy notice was last revised in December 2021.

If we change our privacy notice in a way that significantly changes how we process the Personal Data that we hold about you, we will also ask you to confirm that you are happy with those changes through the most appropriate method (e.g. in email or a notification on our website).
